Terms of Service

1. Definitions

"Platform" refers to the Elgarde website (elgarde.eu), APIs, and all related services operated by HOLY CHAOS, UNIPESSOAL LDA.
"User" refers to any person or entity that accesses the Platform.
"Customer" refers to a User who purchases a paid service (report or subscription).
"Report" refers to any compliance analysis document generated by the Platform, whether free (summary) or paid (full report).
"Scan" refers to the automated compliance audit performed by the Platform on a given domain.
"Subscription" refers to a recurring monitoring service with periodic automated scans and alerts.

2. Eligibility

The Platform is designed for business-to-business (B2B) use. By using the Platform, you represent that you are acting on behalf of a business entity, not as a consumer. You must be at least 18 years of age. If you are accessing the Platform on behalf of an organisation, you represent that you have the authority to bind that organisation to these terms.

3. Account registration

Some features require account registration. We use passwordless authentication via magic links sent to your email address. No passwords are stored. You are responsible for maintaining the security of the email account associated with your Elgarde account. You must notify us immediately of any unauthorised access.

4. Free scan

The free scan provides a compliance grade (A through F) and a summary of the top violations detected. Free scans are provided "as is" with no warranty regarding completeness or accuracy. Results represent a point-in-time snapshot based on automated analysis. We reserve the right to limit the number of free scans per user, domain, or IP address to prevent abuse.

5. Paid reports

Full compliance reports are available at no charge to registered users. Reports are delivered digitally as a PDF and web-accessible document. Free-tier users are required to display an Elgarde badge on their website for the duration of their use of the free service; failure to maintain the badge may result in suspension of free report access. Reports are licensed for the Customer's internal business use only. Redistribution, resale, or public disclosure of the report content without prior written consent is prohibited.

6. Monitoring subscriptions

Monitoring subscriptions (Starter, Pro, and Agency) provide periodic automated scans and compliance alerts. Subscriptions auto-renew at the end of each billing cycle unless cancelled before the next renewal date. You may cancel at any time; cancellation takes effect at the end of the current billing period. We will communicate price changes at least 30 days before they take effect. Current pricing: Starter €15/month or €144/year (1 site), Pro €39/month or €390/year (up to 5 sites), Agency €119/month or €1,190/year (up to 25 sites).

7. Intellectual property

All Platform content, reports, methodology, scan engine code, and associated documentation are the intellectual property of HOLY CHAOS, UNIPESSOAL LDA. Customers retain ownership of their own data. By using the Platform, Customers grant us a limited licence to process their data for the purpose of delivering the requested services. Reports may not be used to misrepresent compliance status or to make claims of compliance based on partial or outdated scans.

8. Limitation of liability

The Platform is provided "as is" for professional B2B use. We are not a law firm and do not provide legal advice. Reports are informational and identify potential compliance issues based on automated scanning. We do not guarantee that a website is fully compliant based on a passing scan, nor that all violations are detected. Our maximum aggregate liability for any claim arising from use of the Platform is limited to the total amount paid by the Customer in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages. We are not liable for the content or practices of third-party websites scanned through the Platform.

9. Acceptable use

You agree not to:

• Reverse-engineer, decompile, or attempt to extract the source code of the scan engine or any other Platform component.
• Use automated tools to access the Platform at scale without a separate API agreement.
• Use reports or scan results to harass, extort, or threaten the operators of scanned websites.
• Misrepresent your authority to act on behalf of a scanned domain when purchasing paid services.

10. Termination

We may suspend or terminate accounts that violate these terms, engage in abusive behaviour, or pose a security risk to the Platform. Customers may close their account at any time by contacting legal@elgarde.eu. Upon account closure, data is deleted in accordance with the retention periods stated in our Privacy Policy.

11. Governing law and jurisdiction

These terms are governed by the laws of Portugal. Any disputes arising from or in connection with these terms shall be submitted to the exclusive jurisdiction of the courts of Porto, Portugal. For EU businesses: the European Commission's online dispute resolution (ODR) platform is available at https://ec.europa.eu/consumers/odr. As a B2B platform, we do not participate in consumer arbitration proceedings.

12. Changes to these terms

We may update these terms to reflect changes in our services or applicable law. Material changes will be communicated at least 30 days before they take effect. Continued use of the Platform after changes take effect constitutes acceptance of the revised terms.

13. Severability

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. These terms constitute the entire agreement between you and HOLY CHAOS, UNIPESSOAL LDA regarding use of the Platform. These terms may not be assigned or transferred without our prior written consent.
